notably fresh. A well-preserved copy of an important work. $750.
* Second edition. The first edition of this classic treatise was
published in 1824. Its final edition, the seventh, appeared in 1877.

importance, and Mr. Angell, in his work, has commendably discussed the
subject. Local legislation has altered, in many of the states, the
common law relative to water courses, but this does not preclude the
necessity in many cases of resorting to well settled principles in

4.     First Report of the Landmark Dartmouth College Case

Judicature of the State of New-Hampshire, November 1817. And on Error
in the Supreme Court of the United States, February 1819. Portsmouth:
Published by John W. Forster and Weste, [1819]. Octavo (5" x 9").
[iv], 406 pp. Original tan quarter-paper spine with printed label over
gray paper-covered boards, deckle fore-edge. A few tiny stains to
binding, light rubbing to boards, joints starting, a few vertical
splits through spine. One signature near center of text block
partially detached, binding otherwise tight. Early owner signature to
front free endpaper, interior notably fresh. A well-preserved
unsophisticated copy. $1,500.
* First published report of the landmark case involving the contract
rights of corporations. With all the material related to the case,
including the arguments of Webster and Wirt and the opinions of Chief
Justice Marshall and Justices Story and Washington, and an appendix
containing the texts of related documents. The New Hampshire
legislature passed a bill in 1816 that revoked Dartmouth College's
original charter and converted the college from a private to a state
institution. The college challenged the constitutionality of this act
in the state supreme court without success, but the U.S. Supreme Court
reversed the state's decision in a landmark opinion based on the
contract clause of the Constitution (Article I, Section 10). "By
construing the contract clause as a means of protecting corporate
charters from state interventions, Marshall derived a significant
limitation on state authority. As a result, various forms of private
economic and social activity would enjoy security from state
regulatory policy. Marshall thus encouraged, through constitutional
sanction, the emergence of the relatively unregulated private,
autonomous economic actor as the major participant in a liberal
political economy that served the commonwealth by promoting

* Authoritative biographies of 1,589 chancellors, masters of the
rolls, and judges of the courts are provided for each reign, from the
time of the Norman Conquest through the reign of Queen Victoria, 1066-
1864. Based on original sources, it is an important reference work for
legal historians. Considered "the standard authority" in its field by
J.C. Robertson in the (cited in the Dictionary of National Biography),
it is frequently cited by Holdsworth in A History of English Law. "A"

* Kemper was an influential authority on Dutch constitutional law. He
was Professor of Jurisprudence at the University of Leiden, and later
became the university's Rector. He framed Holland's post-Napoleonic
constitution that established the constitutional monarchy that exists
today. Redevoeringen is a collection of addresses and lectures. The
second work is a study of Dutch constitutional law. The third is an
address in Kemper's honor by Cras. Not in the British Museum
Catalogue.

8.     Memoirs of a Distinguished Harvard Law Professor

1943 advertising a volume of excerpts from this book laid-in. Light
foxing to preliminaries, internally clean. An appealing copy of a rare
title. $150.
* From an edition limited to 1000 copies, this number 63. "For Loring
J. Whiteside/ Edward H. Warren' in fine hand to limitation statement.
Warren attended Harvard College from 1891 to 1895 and Harvard Law
School from 1897 to 1900, where his principal instructors were Ames,
Gray, Smith and Thayer. After four years at Strong and Cadwalader, he
joined the Harvard Law faculty, where he remained  until his
retirement. With a manner reminiscent of Professor Kingsfield, he
offers a fascinating account of Harvard Law School from the turn of
the century to the 1940s, colorful sketches of his professors and
Cadwalader and a summary of his "Spartan" approach to pedagogy. Warren
also includes the texts of various addresses and articles dealing with
Harvard, legal history, the American Bar and political topics.
